Effective immediately, this revised class deviation temporarily waives the prohibition at 10 U.S.C. 4663 for Alibaba Group Holding Limited and Alibaba Group (U.S.), on contracting with an entity, a parent company of such entity, or a subsidiary of such entity that is a party to a contract with an entity that engages in “lobbying activities”. Alibaba Group Holding Limited and Alibaba Group (U.S.) are exempt from treatment as a Chinese military company for purposes of 10 U.S.C. 4663 only. In addition, this revision provides direction to contracting officers on the suspension of the Cybersecurity Maturity Model Certification Phase 2 implementation.
